The failure of CENTURY to exercise or enforce any right or provision of these Terms of Use shall not operate as a waiver of such right or provision.

These Terms of Use shall be interpreted and governed in accordance with material Swiss law to the exclusion of conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods.

To the extent permitted by law, the competent courts of Nidau/Switzerland shall have exclusive jurisdiction in respect of any dispute arising from these Terms of Use and your use of this Website, subject to CENTURY’s right to prosecute a user at his/her place of residence.

2. Sales conditions - online store

These are the Sales Conditions of CENTURY Time Gems Ltd., Zihlstrasse 50, 2560 Nidau, Switzerland (“CENTURY”, “we”, “us”, “our”).

These Sales Conditions apply to the sale of products on www.century.ch and www.century.com (“Website”).

You will be asked to read and accept our terms and conditions each time you place an order. If you do not accept these terms and conditions, you cannot order any products on our Website

By placing an order on this Website, you are confirming us to be of sufficient legal age and legally capable to enter into a contract.

2.1 Order

Any order placed through the Website requires the creation of an account. By placing an order on our Website you are offering to purchase a product under the Sales Conditions.

After placing an order, you will receive an email from us to confirm that we have received it (order acknowledgement). Please note that this does not mean that your order has been accepted by us. Orders are subject to the acceptance by us and availability of the ordered products.

We reserve the right to collect additional information related to your identity and credit checks.

We reserve the right to refuse or cancel any order for any reason and no order will be accepted until payment is received in full.

Our acceptance of your order will only take place when we send you a confirmation email (invoice), at which point a contract is formed between you and us.

2.3 Prices

All Prices are shown either in CHF, EURO or USD depending on your personal location or the shipping address.

Prices in CHF and EURO are incl. VAT and shipping costs.
Prices in USD are excl. VAT, excl. customs and duties.

You agree to pay in full the prices for any purchases you make according our payment method. You agree to pay all applicable taxes if there is any.

We may change the prices on the Website at any time and without prior written notice. (not applicable to prices confirmed by us in our order confirmation).

If you are interested in purchasing a product which is not available in our online shop, please contact us directly info@century.ch.

2.4 Delivery & Shipping

Estimated delivery times are specified in the checkout process and confirmed in the order confirmation.

If we cannot deliver within the estimated delivery time, we will write you to propose a new delivery date.

To check whether a shipment to your country is available, check if your country is available on the list provided on the Website.

Shipping costs are free of charge (section 2.3). For costs related to duties and customs, please refer to below section.

2.5 Customs & Duties and insurance

All orders in CHF or EUR are fully insured against loss, theft or damage.
Furthermore, we ship those orders with duties and taxes paid (DDP) so that there will be no further costs to you.

All orders in USD get shipped fully insured against loss, theft or damage.
We ship those orders without duties and taxes paid (DAP) so that there might be further costs to you.

2.6 Transfer of ownership and risk

You will be responsible for the product from the time it has been delivered to the address you gave us in your order. This means that you will be responsible for damage caused to the products, whether this is by use, storage or handling of the products. The risks associated with the return of a product, whatever the reason, lies with you.

2.7 Returns

Subject to certain exceptions, if for any reason you are not satisfied with your order made on our online shop, you may exercise your right to return us the purchased product within fourteen (14) days after receiving the product.

To return the purchased product, please contact us immediately by email at info@century.ch. and inform us about your decision to cancel this contract through clear statement.

Our CENTURY Customer Service representative will contact you as soon as possible to provide you with the necessary return instructions. If you do not get a reply from us in the following five (5) days, please contact us immediately by phone +41 32 332 98 88.

All products must be returned with the original receipt, in a new and unused state, in perfect condition, with its warranty card, watch box, all its accessories and all original shipping papers and packaging. Protective materials must be in place and identification tags and stickers must be attached to the product.

Watch bracelet that have been adjusted at your request must be returned in the original condition, with the exact same number of links.

CENTURY reserves the right to refuse your return if the product shows signs of wear, or has been used or altered from its original condition in any way, or if the 14 day return authorization has passed.

Please note that shipping costs will be at your expense. Any duties, taxes and fees you have paid for the delivery of the purchased products shall not be refunded.

All returns will be subject to strict Quality Control by CENTURY. If the return is not in compliance with our requirements, CENTURY reserves the right to refuse the return or to reduce the amount of the applicable refund.
If everything is in order, CENTURY will transfer you the paid amount back. If taxes were excluded, we cannot pay back these taxes to you.

We may change these Sales Conditions at any time, without notice to you. Such changes are effective when they are posted to this Website.
